Interpretation
Definitions
- "Business Customer" means a person or entity purchasing wholly for business purposes.
- "Contract" means the agreement for the supply of Products and/or Services formed upon the Company's written Order Confirmation.
- "Order" means the Business Customer's request to purchase Products and/or Services, whether placed online, by email or otherwise.
- "Order Confirmation" means the Company's written acceptance of an Order, which may include specifications, pricing, delivery and any special conditions.
- "Products" means any laser devices, handpieces, parts, accessories, consumables and related items supplied by the Company.
- "Services" means any installation, training, maintenance, support or consultancy provided by the Company.
- "Website" means thelasermachineco.co.uk or any successor site.
- "Company," "we," "us," "our" means LMC The Laser Machine Co. Ltd.
In these Terms: references to a statute include all subordinate legislation and amendments; words in the singular include the plural and vice versa; "including" means including without limitation; and headings are for convenience only and do not affect interpretation.
Scope & Website Use
These Terms govern your use of the Website and all business sales of Products and Services.
You must not misuse the Website. All site content is our intellectual property and may not be copied or reproduced without authorisation.
Any written terms agreed with you that expressly override these Terms will prevail.
Orders & Contract Formation
Listings on the Website are invitations to treat, not offers. A Contract is formed only when we issue an Order Confirmation in writing.
Please check model, voltage/plug type, and quantities carefully before ordering. We may refuse orders (for example due to availability, errors, or export restrictions). Where payment has already been taken for a refused order, we will refund any sums paid without undue delay.
Prices & Payment
We are not VAT-registered; we do not charge VAT.
Prices exclude delivery unless stated otherwise. Payment is required in advance unless a credit account has been agreed in writing.
Late payment interest and fixed compensation under the Late Payment of Commercial Debts (Interest) Act 1998 will apply to overdue sums. We may suspend further deliveries or services if any amount is outstanding. We may also recover reasonable costs of debt recovery in addition to statutory interest and compensation.
Delivery, Risk & Title
Delivery dates are estimates only; time is not of the essence. We will keep you informed of any material delays.
Risk passes on delivery to your carrier or your site as applicable.
Title to Products passes only when we have received cleared payment in full for all sums due under the Contract. Until title passes, you must store Products separately and clearly as our property, keep them insured, and allow us to enter your premises to recover Products if payment is not made when due. You may resell in the ordinary course of business, holding proceeds on trust for us until we have been paid in full. Our rights under this clause survive termination.
You must inspect Products on delivery. Notify us of any shortages or transport damage within 48 hours with supporting photographs; notify any apparent defects within 7 days. After those periods, Products are deemed accepted, subject only to the Warranty for latent defects.
Products are supplied for use by the purchasing Business Customer only. You must not resell, lease, or transfer any Product to a third party without our prior written consent. Where Products are resold or transferred without authorisation, we accept no responsibility for the condition, performance, or safety of the Product, and any manufacturer warranty will be void.
Suitability, Compliance & Safety
You are solely responsible for verifying the fitness for purpose of Products for your intended use, ensuring local regulatory compliance, and confirming that all operators are competent, trained, and appropriately insured.
Laser devices are typically Class 4 and must be used in a controlled area with appropriate door signage, wavelength-appropriate protective eyewear for all persons present, and plume extraction during pigment or tattoo work.
You must always follow the User Manual, applicable local rules, and your insurer's guidance.
You must maintain appropriate insurance, including public liability and treatment liability insurance, for the operation of any Products supplied. We accept no responsibility for verifying your insurance coverage.
Parameter Guidance
We may provide parameter guidance, reference charts, or treatment materials as part of training or product documentation. Such materials are provided for general guidance only and do not constitute definitive clinical treatment protocols.
Laser treatment parameters must always be determined by the practitioner based on:
- client skin type and condition
- treatment area
- patch test results
- clinical judgement
- ongoing assessment during treatment
The practitioner is solely responsible for ensuring treatments are safe and appropriate for each individual client.
Setup, Operation & Maintenance
You are responsible for ensuring all Products are correctly installed, set up, operated, and maintained in accordance with the user manual, training provided by us, manufacturer guidance, and applicable safety and maintenance requirements. This includes ensuring correct power supply and voltage compatibility, appropriate environmental conditions, completion of regular maintenance procedures, and replacement of consumables and maintenance items when required.
Failure to follow required setup, operation, or maintenance procedures may result in equipment malfunction and may invalidate warranty coverage. We accept no liability for faults, damage, or performance issues arising from incorrect setup, operation, or maintenance.
Training & Installation
Where training is purchased, it is delivered at our clinic (538 Burnley Rd, Crawshawbooth, Rossendale BB4 8NE) on dates confirmed by us in writing. Models are provided by LMC. You must ensure your attendees arrive on time and comply with all clinic policies.
Certificates confirm attendance and competence on the day; they are not a licence to practise. Ongoing competence and continued professional development remain your responsibility.
If you request to move a confirmed training date within 14 days of that date, a reasonable rescheduling fee may apply to cover clinic and model costs actually incurred.
Training provided by us is intended for educational and operational purposes only. Completion of training or receipt of a certificate does not qualify attendees to perform medical treatments or provide medical advice. You and your trainees are solely responsible for ensuring that appropriate qualifications, insurance, and regulatory approvals are held for treatments performed.
Returns
We do not accept returns except as set out in the Warranty or where agreed in writing at our discretion. Agreed discretionary returns must be in unopened, as-new condition and may attract a restocking fee of up to 20% plus carriage costs. Opened consumables and used handpieces are non-returnable unless defective.
Troubleshooting & Support
If an issue arises with a Product, you must first follow the Troubleshooting Steps in your user manual. Then email photos or video evidence and any error messages to thelasermachineco@gmail.com for remote diagnosis.
You must stop using the device if continued use risks further damage — for example if there is low or no water, unusual noise, or the device is showing error states.
If remote diagnosis is not possible, the inspection pathway in clause 10 applies.
Inspection Pathway (Return-to-Base)
Inspection is return-to-base at: 538 Burnley Rd, Crawshawbooth, Rossendale BB4 8NE. We do not offer call-outs.
You are responsible for safe, insured carriage of the device to us. You must drain any water, pack the device in accordance with our guidance, and insure it in transit. Risk in transit to us remains with you.
Where a manufacturing defect is confirmed under the Warranty, we will repair or replace the device within a reasonable time and cover reasonable return carriage back to you.
Where no defect is found — for example where the issue results from setup, operation, or maintenance — the unit will be returned and return carriage (and any reasonable diagnostics costs) may be chargeable.
Warranty
Unless stated otherwise, new devices include a 12-month manufacturer warranty against defects in parts only. Wear items and consumables (such as bulbs) are not covered.
The warranty does not cover:
- misuse or neglect
- operation contrary to the user manual (including running the device with low or no water)
- unauthorised repair or modification
- inadequate maintenance
- external factors including power surges, corrosion, impact, or transport damage occurring after delivery
Warranty remedies are at the manufacturer's or our option: repair or replacement within a reasonable time. Where those remedies are not feasible, a price reduction or refund may be offered.
To make a warranty claim you must complete the troubleshooting process, provide supporting evidence, and make the device available for inspection in accordance with clauses 9 and 10.
Repair or replacement of a Product does not extend the original warranty term. Loan equipment is not provided unless agreed in writing.
Software & Firmware
Unless expressly agreed in writing, we are under no obligation to provide software updates, firmware upgrades, or feature enhancements after delivery. Where updates are provided, they are at our discretion and may be subject to additional charges.
Preventative Maintenance
You must perform routine preventative maintenance as recommended in the user manual and training guidance. Warranty claims may be refused where reasonable maintenance procedures have not been followed.
Services Warranty
We will provide Services with reasonable care and skill. If you believe we have not done so, you must notify us within 7 days and we will correct the issue within a reasonable time.
Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be limited.
Subject to the above, our total aggregate liability arising out of or in connection with a Contract shall not exceed the price paid for the Product or Service giving rise to the claim.
We exclude all liability for indirect or consequential loss, including loss of profit, revenue, business, contracts, goodwill, or anticipated savings.
To the fullest extent permitted by law, all terms implied by statute or common law are excluded, including any implied terms as to satisfactory quality or fitness for purpose.
You agree to indemnify and hold harmless the Company, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses arising from:
- misuse or improper operation of the Products
- failure to follow training, safety guidance, or manufacturer instructions
- failure to comply with regulatory or licensing requirements
- treatment outcomes or services performed by you using the Products
Data Protection
We process business contact data and technical information to fulfil orders, provide support, and maintain safety records, in accordance with our Privacy Policy.
Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier issues, supply shortages, strikes, regulatory changes, or epidemics. We will keep you informed and resume performance as soon as reasonably possible.
Governing Law & Jurisdiction
These Terms and any Contract are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute.
Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your Order Confirmation applies to that order. The "last updated" date at the top of this page indicates the current version.
Entire Agreement & Non-Reliance
Each Contract constitutes the entire agreement between the parties and supersedes all prior discussions, proposals, and representations relating to its subject matter. Each party agrees that it has not relied on any statement or representation not set out in the Contract. Nothing in this clause limits or excludes liability for fraud or fraudulent misrepresentation.
Suspension & Termination
We may suspend performance or terminate a Contract immediately by notice if you: fail to pay any sum when due and do not remedy this within 7 days of notice; commit a material breach and fail to remedy within 14 days of notice; or are subject to insolvency proceedings or cease trading. Termination is without prejudice to our accrued rights and our entitlement to recover Products under clause 5.
Intellectual Property
All intellectual property rights in the Products, firmware, software, manuals, and training materials are owned by us or our licensors. We grant you a non-exclusive, non-transferable licence to use manuals and software solely to operate the Product in your business. You must not copy, adapt, reverse engineer, or sublicense any materials except to the extent permitted by law.
Notices
Notices under a Contract must be in writing and delivered by hand, pre-paid post, or email to the addresses set out in these Terms (or as otherwise notified in writing). Notices are deemed received: by hand — on delivery; by post — 2 business days after posting; by email — on transmission if sent before 5pm UK time on a business day, otherwise the next business day.
Reasonableness
The parties acknowledge that the exclusions and limitations of liability in clause 13 are reasonable and are reflected in the pricing and risk allocation agreed between business parties.
Compliance
You will comply with all applicable laws and professional and insurer requirements when operating Products, including laser safety controls: controlled area with appropriate signage, wavelength-appropriate eyewear for all persons present, and plume extraction where pigment is being treated. You will not export or resell Products in breach of sanctions or export controls, and will comply with anti-bribery and modern slavery laws.
Regulatory Compliance
You are solely responsible for ensuring compliance with all applicable regulatory requirements relating to the operation of laser equipment, including:
- MHRA guidance
- Local authority licensing requirements
- Health & Safety Executive (HSE) laser safety guidance
- Insurance and professional body requirements
We do not provide regulatory approval or licensing and accept no responsibility for your compliance with such obligations.
Export & International Use
Products are supplied for use within the United Kingdom unless otherwise agreed in writing. You are responsible for ensuring compliance with all applicable laws, regulations, and import requirements if any Product is exported or used outside the UK. We accept no responsibility for regulatory compliance in jurisdictions outside the United Kingdom.
Third-Party Rights
A person who is not a party to the Contract shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.
Severance
If any provision of the Contract is found invalid, illegal, or unenforceable, it shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions. Where any provision would be valid with minimum modification, it shall apply with that modification.
